Court Gives Preliminary Approval to $2.3 Million Settlement in Smith vs. Housing & Community Development Corp. of Hawaii, Civil No. 04-1-0069K.

A settlement has been given preliminary approval by the Third Circuit Court in the Smith v. HCDCH state-wide class action. On June 23, 2006, the court approved a settlement that established a fund of up to $2.3 million for the members of the class who did not receive utility allowances required by federal law. Shelby Anne Floyd, a director of Alston Hunt Floyd & Ing, is lead counsel for the plaintiffs. A final fairness hearing will be held on November 8, 2006.
